Our Public Records Request Policy outlines the procedure for making a request. The fee schedule is posted below with the link to our Public Records Request online form. If you have any questions, please contact us.




PUBLIC RECORDS REQUEST FEES & PROCESS

We strive to adhere to all Oregon State Statues and Administrative Rules governing our district.

Fee Schedule

  • Staff Research Time – $25/hour
  • Photocopies – 25 cents per page
  • Scanning – 25 cents per page
  • USB Drive – $15 (drive provided)
  • Certified Copies – case by case
  • Mailing/Postage – actual cost
  • Attorney Review – $380/hour

ORS 192.324 – “A public body that is the custodian of any public record that a person has a right to inspect shall give the person, upon receipt of a written request:

(a) A copy of the public record if the public record is of a nature permitting copying; or (b) A reasonable opportunity to inspect or copy the public record.”

(2) requires: “…the public body shall within five business days after receiving the request acknowledge receipt of the request or complete the public body’s response to the request.

The acknowledgment must:

  • Confirm the agency has the records,
  • State the agency does not have the records, or
  • State the agency is uncertain whether it has the records.

(5) states: “As soon as reasonably possible but not later than 10 business days after the date by which a public body is required to acknowledge receipt of the request…” the public body must either:

  • Complete the request, or
  • Provide a written estimate of when the request will be completed.

In practice, this means:

  • 5 business days → acknowledge request
  • An additional 10 business days → either fulfill request or provide written estimated completion date.

Under ORS 192.311: “Public record” includes any writing that contains information relating to the conduct of the public’s business…”

That definition includes:

  • Emails
  • Texts related to public business
  • Meeting records
  • Audio/video
  • Electronic files
  • Paper documents

For a fire district like Mid Rogue Fire District, this generally includes:

  • Board meeting records
  • Contracts
  • Financial records
  • Policies
  • District emails relating to public business
  • Incident reporting records (subject to exemptions)
  • Personnel records (with some exemptions)

Certain records can still be exempt or partially redacted under Oregon law.
